CONSUMER PRODUCT SAFETY SERVICES

Overview

A Children’s Product Certificate (CPC) is a legal requirement under the U.S. Consumer Product Safety Improvement Act (CPSIA). This applies to all imported, produced, or sold children's products in the United States. The CPC proves that the product meets all safety standards and regulations set by the Consumer Product Safety Commission (CPSC). The manufacturer's or importer's CPC must be supported by test results from a third-party lab accepted by the CPSC.

CPC compliance is mandatory for U.S. businesses and international brands entering the U.S. market. It applies to all types of children’s products — toys, baby clothes, childcare goods, or baby accessories. Any product marketed for children under 12 years must be validated by a CPSC-accepted lab.

At Phoenix Safety Consultants, we assist clients by documenting all compliance steps required for CPC certification. Our documentation aligns with the CPSIA, CPSA, and FHSA standards to ensure complete and professional compliance.

What Is a Children’s Product Certificate (CPC)?

A Children’s Product Certificate (CPC) is a written certification required under sections 101–108 of the CPSIA and supported by the Consumer Product Safety Act (CPSA) and the Federal Hazardous Substances Act (FHSA). It is the official declaration by a manufacturer or importer that a product meets all applicable federal safety standards enforced by the CPSC — including restrictions on lead, phthalates, flammability, sharp points, and other mechanical hazards.

The CPC applies to any children’s product intended for children aged 12 or younger. This includes toys, clothing, nursery items, feeding accessories, and other products for child use or play.

A valid CPC is based on product testing performed by a CPSC-accepted third party. It confirms that every regulated product complies with the following standards:

  • ASTM F963 – Standard Consumer Safety Specification for Toy Safety
  • 16 CFR Part 1303 – Lead in Paint and Surface Coatings
  • 16 CFR Part 1500 – Hazardous Substances and Banned Toys/Articles
  • 16 CFR Part 1501 – Small Parts Regulations
  • 16 CFR Part 1610 – Flammability of Clothing Textiles

Holders of a compliant CPC affirm that their products meet the CPSIA safety framework — protecting consumers while ensuring seamless entry through U.S. customs inspections.

Who Must Issue the CPC?

The responsibility to issue a Children’s Product Certificate lies with:

  • The U.S. manufacturer, if the product is produced domestically.
  • The importer of record, if the product is manufactured outside the United States.

Each CPC must reference actual product testing results from a CPSC-accepted laboratory. Children’s products may not be self-certified.

According to 16 CFR §1110.11, each CPC must include seven key elements:

  • Identification of the product covered by the certificate.
  • Citation to each applicable CPSC regulation or safety rule.
  • Identification of the U.S. importer or domestic manufacturer issuing the certificate.
  • Contact information for the individual maintaining the test records.
  • Date and place of manufacture.
  • Date and place of testing and the CPSC-accepted laboratory’s name and address.
  • A digital or physical signature certifying compliance.

Failure to properly issue or maintain a CPC can lead to CPSC enforcement actions, including civil penalties or customs detention of imported goods.

Why It’s Required

The CPC system ensures children’s products meet federal safety regulations. The CPSC enforces compliance through the Consumer Product Safety Act (CPSA) and may request CPC documentation at any time.

Failure to provide a valid CPC can result in:

  • Seizure of goods or refusal of entry by U.S. Customs and Border Protection (CBP)
  • CPSC-enforced recalls or cease-sale orders
  • Civil penalties up to $120,000 per violation and up to $17 million for repeated offenses
  • Reputational and partnership damage

A CPC demonstrates due diligence, accountability, and product traceability — essential for compliance within the U.S. market.
